TERMS AND CONDITIONS OF TRADING
as at 1st JUNE 2008

1. These terms and conditions apply to all orders placed and supplied by J & K Aquatics Ltd and the placing of such an order by the customer implies acceptance of the conditions.

2. The prices shown in the catalogue are correct at the time of printing, but may vary due to price rises etc. The prices charged to the customer will be those in operation at the time of despatch, with the trade and retail prices being clearly stated on the relevant invoice.

3. Retail prices include VAT and trade prices quoted exclude VAT. All trade invoices will have VAT charged at the rate in force at the time, except goods supplied for export etc.

4. All goods supplied remain the property of J & K Aquatics Limited until paid for in full. Payment must be made by cash or cheque at the time of delivery unless otherwise agreed.

5. If any cheque presented for payment is dishonoured, a charge of £15 will be invoiced for each time the cheque fails to clear. If payment of a dishonoured cheque has not been made in full within 28 days interest shall be charged at 5% over bank rate per calendar month on the outstanding balance until the debt is settled. Any further transactions will be on a cash only basis.

6. Overdue accounts will be charged interest at a rate of 5% over bank rate on the outstanding balance until the debt is settled. Any further transactions will be on a cash only basis.

7. Fragile goods such as aquariums, light tubes etc must be examined at the time of delivery, as no claims for damaged goods will be entertained after the delivery driver or carrier has left the premises. There is no need to check through the entire order with the driver present as the order is double checked before it is despatched, but if in your opinion, there is a discrepancy we must be informed within 24 hours of delivery.

8. Returns will be uplifted and brought back with the relevant returns note for examination and if valid will be replaced along with the next delivery. Anyone wishing to return good stock after 28 days from the invoice date, must have authorisation from the customer service department. As this is at the discretion of J & K Aquatics Ltd, a surcharge of 10% may be made for handling.

9. Where delivery is made by carrier, a charge at cost will be made and added to the total cost of the goods delivered which will also be deemed to be a part of the purchase price. Unfortunately, we are unable to ship certain fragile items by carrier - please ask for more information.

10. Special orders will be considered to be firm and binding. We will aim to deliver special orders within 2 weeks of the goods arriving at J & K Aquatics Ltd (by carrier service if necessary). We will accept no responsibility for any delays due to our suppliers.

11. Cash and carry only available by prior appointment – 24 hours notice is required.

12. If you wish to send in a carrier to uplift goods on your behalf, a surcharge of £15 will be made for packaging and handling. This is only available by prior arrangement, again 24 hours notice is required.

Minimum order £325 nett qualifies for free delivery on our own transport.

All orders should be placed by 12 noon at least a day before the normal

delivery.
